Terms and conditions for using Diserrisol services

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Diserrisol Pty Ltd ("Diserrisol," "we," "our," or "us") regarding your use of our website diserrisol.com and our public speaking courses, training programs, and related services.

By accessing our website, enrolling in our courses, or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.

2. Description of Services

Diserrisol provides public speaking courses, presentation skills training, communication coaching, and related educational services. Our services include:

  • In-person and online public speaking courses
  • Individual and group coaching sessions
  • Corporate training programs
  • Workshops and seminars
  • Educational content and resources
  • Online learning materials and tools

3. Eligibility

To use our services, you must:

  • Be at least 18 years old or have parental/guardian consent
  • Have the legal capacity to enter into binding agreements
  • Provide accurate and complete information when registering
  • Comply with all applicable laws and regulations

4. Course Enrollment and Payment

4.1 Registration

Course enrollment requires completion of our registration process and payment of applicable fees. All course information, including schedules, locations, and content, is subject to change with reasonable notice.

4.2 Payment Terms

  • All fees are quoted in Australian Dollars (AUD) and include GST where applicable
  • Payment is due at the time of enrollment unless other arrangements are made
  • We accept payment by credit card, bank transfer, or other approved methods
  • Failed payments may result in course access suspension

4.3 Pricing Changes

We reserve the right to modify course prices at any time. Price changes will not affect existing enrollments but will apply to new registrations.

5. Cancellation and Refund Policy

5.1 Student Cancellations

  • More than 14 days before course start: Full refund minus administrative fee (10% or $50, whichever is greater)
  • 7-14 days before course start: 50% refund
  • Less than 7 days before course start: No refund, but credit toward future course available
  • After course commencement: No refund or credit

5.2 Diserrisol Cancellations

If we cancel a course due to insufficient enrollment or unforeseen circumstances, you will receive a full refund or may transfer to another available course.

5.3 Medical/Emergency Exceptions

Exceptions to the cancellation policy may be made for documented medical emergencies or exceptional circumstances at our sole discretion.

6. Course Attendance and Participation

6.1 Attendance Requirements

  • Regular attendance is essential for course completion
  • Make-up sessions may be available for excused absences
  • Excessive absences may result in course dismissal without refund

6.2 Student Conduct

Students must:

  • Treat instructors and fellow students with respect
  • Arrive punctually and prepared for sessions
  • Participate constructively in course activities
  • Maintain confidentiality of other students' personal information
  • Follow facility rules and safety guidelines

6.3 Dismissal

We reserve the right to dismiss students for disruptive behavior, non-payment, or violation of these terms without refund.

7. Intellectual Property

7.1 Our Content

All course materials, including but not limited to curricula, handouts, presentations, videos, and training methodologies, are the intellectual property of Diserrisol and are protected by copyright and other intellectual property laws.

7.2 License to Use

We grant you a limited, non-exclusive, non-transferable license to use course materials solely for personal educational purposes. You may not:

  • Reproduce, distribute, or sell course materials
  • Create derivative works based on our content
  • Use our materials for commercial training purposes
  • Remove copyright or proprietary notices

7.3 Student Feedback

By participating in our courses, you grant us permission to use your feedback, testimonials, and success stories for marketing purposes, unless you specifically opt out.

8. Privacy and Confidentiality

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

We maintain confidentiality regarding your participation in our programs and will not disclose personal information shared during training sessions without your consent, except as required by law.

9. Technology and Online Services

9.1 Technical Requirements

For online courses, you are responsible for having adequate internet connectivity, compatible devices, and necessary software. We are not liable for technical issues that prevent your participation.

9.2 Platform Access

Access to online learning platforms is provided for the duration of your course enrollment. We reserve the right to discontinue platform access after course completion.

9.3 Recording Consent

Online sessions may be recorded for quality assurance and make-up session purposes. By participating, you consent to such recordings.

10. Disclaimers and Limitations of Liability

10.1 Educational Services

Our services are educational in nature. While we strive to provide valuable training, we cannot guarantee specific outcomes, career advancement, or business success as a result of course participation.

10.2 Limitation of Liability

To the maximum extent permitted by law, Diserrisol's total liability for any claims arising from or related to our services shall not exceed the amount you paid for the specific course or service giving rise to the claim.

10.3 Consequential Damages

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, business opportunities, or reputation.

11. Indemnification

You agree to indemnify and hold harmless Diserrisol, its instructors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your violation of these Terms
  • Your misuse of our services or materials
  • Your violation of any third-party rights
  • Any false or misleading information you provide

12. Force Majeure

We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, pandemics, labor disputes, or technical failures.

In such cases, we will make reasonable efforts to reschedule courses or provide alternative delivery methods.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of Victoria, Australia, and you submit to the exclusive jurisdiction of the courts of Victoria.

13.2 Dispute Resolution

Before initiating legal proceedings, parties agree to attempt resolution through:

  1. Direct negotiation between the parties
  2. Mediation through an agreed mediator
  3. If necessary, arbitration under the rules of the Australian Centre for International Commercial Arbitration

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting on our website. Material changes will be communicated to enrolled students via email.

Your continued use of our services after changes become effective constitutes acceptance of the modified Terms.

15. Termination

Either party may terminate the service relationship at any time:

  • You may cancel your enrollment subject to our cancellation policy
  • We may terminate your access for breach of these Terms
  • We may discontinue services with reasonable notice

Termination does not affect rights and obligations that arose before termination.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. The unenforceable provision will be replaced with an enforceable provision that most closely reflects the original intent.

17. Entire Agreement

These Terms, together with our Privacy Policy and any specific course agreements, constitute the entire agreement between you and Diserrisol regarding our services and supersede all prior or contemporaneous communications.
